Canada Narrows Spouse Work Permits in 2025, Who Still Qualifies
Canada narrowed family open work permits on January 21, 2025. See who still qualifies, the TEER and 16-month rules, and the new exceptions added in 2026.

The rules for Canadian work permits changed on January 21, 2025, but not in the way many people expected. On that date, IRCC narrowed who can get a family open work permit. Here is what changed, who still qualifies, and what it means if you plan to work in Canada.
What Changed on January 21, 2025?
IRCC announced the change on January 14, 2025. From January 21, 2025, only spouses of certain international students and foreign workers can apply for a family open work permit. Dependent children of foreign workers are no longer eligible.
For spouses of students, the student must be in a master's program of 16 months or longer, a doctoral program, or a select professional program. For spouses of workers, the worker must be in a TEER 0 or 1 job, or a select TEER 2 or 3 job, and have at least 16 months left on their work permit when the spouse applies. Open work permits approved under the old rules stay valid until they expire.
IRCC says these changes are part of broader measures it announced in September 2024. For context, Canada reached its target of 431,645 new permanent residents in 2022, according to IRCC.
Can You Change Jobs on a Canadian Work Permit?
The January 2025 changes did not create a new job-switching rule. If you hold an employer-specific work permit, you still must apply for a new work permit before you change jobs or employers. Open work permit holders can change employers at any time while their permit is valid.
There is some flexibility. Under a temporary public policy, IRCC says you may be able to start your new job while your new work permit application is processed, by asking for work authorization through its web form. IRCC says it should reply in about 10 to 15 days.
For couples, the bigger change is that a spouse's right to work now depends on the main applicant's job level and the time left on their permit, so check both before you move.

Which Jobs Still Qualify a Spouse for an Open Work Permit?
If the main applicant works in a TEER 0 (management) or TEER 1 (professional) job, their spouse can qualify. IRCC also lists select TEER 2 and 3 jobs, including tech support roles such as computer network and web technicians and user support technicians.
Healthcare is well covered on that list. It includes licensed practical nurses, paramedical occupations, pharmacy technicians, and nurse aides, orderlies and patient service associates.
Skilled trades are on the list too, including electricians, plumbers, carpenters, welders, and automotive service technicians. In each case, the worker also needs at least 16 months left on their work permit when the spouse applies.
What Will This Mean for Applicants?
If you are a foreign worker eyeing Canada, the January 2025 rules did not make your own work permit easier to get. They mainly decide whether your spouse can work too. Check your TEER level and the time left on your permit before you plan a family move.
But here’s the catch. You still need to do your part. Proper preparation is essential, so make sure your qualifications are aligned with Canadian standards, especially if you’re venturing into regulated professions like healthcare or engineering.
What changed since: IRCC has added a few exceptions in 2026. As of March 23, 2026, spouses of workers on significant investment projects in British Columbia can apply at any TEER level. As of May 25, 2026, the 16-month permit rule does not apply to spouses of health professionals recruited by Quebec. Check the IRCC eligibility page before you apply, since these rules keep changing.
Whether you are building a career or starting a new life chapter in Canada, knowing these rules early can help you avoid a refused application.
If you are planning a move, start with the official IRCC pages and keep your documents up to date.
